YOU ARE HEREBY NOTIFIED that on the 31st day of August, 2004, at 10:00 a.m., at the Augusta City-County Building, 530 Greene Street, Augusta, Georgia, in Courtroom 1, the presiding Superior Court Judge will hear the case of the State of Georgia, Plaintiff, v. Housing Authority of the City of Augusta, Georgia and Ashton Bon Air, LP, Defendants, pending in the Superior Court of Richmond County, the same being a proceeding to confirm and validate an issue of Housing Authority of the City of Augusta, Georgia Multifamily Housing Revenue Bonds (Ginnie Mae Collateralized Mortgage Loan Bon Air Apartments Project), Series 2004 (the "Bonds") in the aggregate principal amount of $7,490,000. The Bonds are to be issued in one or more series by the Housing Authority of the City of Augusta, Georgia (the "Issuer"), for the purpose of financing the acquisition, construction and rehabilitation of a 203-unit multifamily housing project in Augusta, Georgia, known as the "Bon Air Apartments" (the "Project"), and to pass upon the validity of the Housing Authorities Law (O.C.G.A. 8-3 1, et seq.), as amended. Said Project will be financed by the Issuer for the benefit of Ashton Bon Air, LP, a Georgia limited partnership, pursuant to a Loan Agreement, to be dated as of August 1, 2004. In said proceeding the Court will also pass upon the validity of said Loan Agreement, a Bond Resolution, a Trust Indenture and a Land Use Restriction Agreement in connection therewith. Said Bonds will mature in the amounts, on the dates and bear interest at the rates set forth in the Trust Indenture.
Any citizen of the State of Georgia residing in Augusta, Georgia, or any other person wherever residing who has a right to object, may intervene and become a party to this proceeding.See the full content of this document
