Downs' Confession Can Be Used at Slaying Trial

Summary


South Carolina officers violated William "Junior" Downs' rights, a prosecutor conceded, but because Mr. Downs waived those same rights before admitting he killed an Augusta child in 1991, a jury can hear his confession, a judge ruled Tuesday.

Mr. Downs, 37, has pleaded not guilty in Richmond County Superior Court to charges including murder in the death of James Porter, 10. He is under a death sentence in South Carolina for killing another child, 6-year-old Keenan O'Mailia.
